  • The object of the Programme was fully achieved by very excellent presentations by all the resource persons.
  • District Administration and its intricacies were very nicely presented by the Resource person.
  • The session on Budget Preparation was very useful.
  • All the topics were very relevant for the day to day functioning as District Judges.
  • Giving topics and asking the participants to make presentations was a very innovative way to improve the communication skills.

    • Regional Programmes may be conducted for two days.
    • Each topic requires at least one day’s discussion.
    • A discussion on court Management may be included in every programme.

One Day Workshop for Principal District Judges - 20th June 2010

The discussions focused on the suggestions that could be put forth to implement the Right to Information Act, 2005, in its true spirit and at the same time also protect the sanctity of the Courts.

To the Hon'ble High Court :

Since the Principal District Judges are already overburdened with judicial and administrative work, it has been suggested that a separate Chief Officer well versed in procedure, even a Judicial Officer, to be notified for each District to act as the Chief Information Officer.

To increase the copying charge for each page of information disclosed from Re.1/- to Rs.2/- to bring the same at par with the copying charges now collected for certified copies of documents furnished under the Civil Rules of Practice and Criminal Rules of Practice.

To the State Government (Through Hon'ble High Court) :

Since certified copies of the proceedings in any Court of Law, or of any order or pleadings can be obtained by making copy applications even by third parties to the litigation, these documents may be kept out of the purview of the Act by making necessary amendment.

To morefully comply with the requirements of the Act, particularly with the stipulations regarding the time limit within which the information sought for is given, it is imperative that a separate section is established in each District with separate staff and infrastructure and budget to attend the applications and provide information. 

To the Central Government and to the Law Commission :

Dispensation of Justice in India through judicial proceedings is conducted transparently.  Every citizen of the country has a right to witness any Court proceedings.  Very rarely are proceedings conducted “in camera”.  They are so conducted, only with a view to protect the privacy of the parties concerned by giving due respect to special circumstances.  It is an exception to the general method of conduct of Court Proceedings.

Taking into consideration the above, it is submitted that suitable amendments are necessary in the Act to bring the judicial proceedings out of the purview of the Act by bringing in necessary amendment to Sec. 8 of the Act.  

It is further submitted that in respect of administrative matters, if request for information is frivolous, it may be declined, for which suitable amendment may be made in Sec. 8 of the Act.

  • New Amendments in various other legislations in the recent period to be included in the topics and discussed in future programmes. 
  • The Values of the Punctuality, Time Management, Work Management are to be discussed. How to extract the work from the staffs concerned? This is the main questions. The respected Tamil Nadu State Judicial Academy is requested to conduct the programme to Principal District Judges and Chief Judicial Magistrates, inrespect of handling and guiding the Sub-Ordinate officers.  
  • This programme will be more effective if a little bit and time is granted for relaxation. The Session goes on without interval which makes us feel like a student
  • When we are overloaded with administrative and Judicial function – Lack of time to ponder over – The programme is not only purposeful and relevant but also has been inculcating knowledge.

Reflective Training Programme for the newly recruited Civil Judges (Junior Division) – III Batch
10th & 11th April 2010

  • The programme should be conducted for 5 days so that we could be able to get more duration for group discussion.

    1) Group discussion may be had for one whole day in the presence of a moderator as we could come across doubts raised by Co - Judges.

    2) More FAQs be added in the TNSJA website.

    3) In Courts situated in remote villages, we lack internet facility. So independent internet facility should be given to us.

  • More time may be given for group discussions. Problems instead of being worked out separately may be discussed as group study which will help in elucidating more ideas. Separate session may be allotted for discussing grievances as we Judicial officers have no other forum to discuss the same.
  • The interaction section for the clearance of doubts may be given. The senior advocates and Judges on the Civil side and Criminal side may be called for separately for clearing the doubts alone.

Refresher Course for Civil Judges (Junior Division) - 20th & 21st March 2010

  • This programme helped us to recollect, refresh and learn more legal aspects in the Evidence law. My doubts on appreciation of evidence are clarified. This would help us to enhance the output.
  • The cases U/S 125 Cr.P.C and U/S 138 NI Act are flooding in every Courts. Therefore, some more lectures may be added in the programme in the area of  ‘dealing of cases U/S 138 NI Act and 125 Cr.P.C’.
  • Classes by senior Magistrate and Munsifs can be included to impart practical training to the Munsif and Magistrates.

13th & 14th March 2010

  • I Submit that the Refresher Course really enriched and enchanced my knowledge about the techniques for quick disposal of MCOP cases, timely disposal of matrimonial disputes and guardianship cases. Appreciation of evidence, judgment writing in Civil appeals, techniques for speedy disposal of LAOP cases and ADR with special reference to Sec. 89 IPC. Rulings of High Court, Madras and  Supreme Court may kindly be circulated to us.
  • I submit that, the refresher programme may kindly be extended at least for one week. Group discussion may kindly be arranged. Interaction with resource persons may be arranged separately by allotting separate time. Library studies may kindly be arranged.
  • It is more effective to have this topics, to those who are promoted as Sub-Judge recently. Also to enlight on the topic, how to conduct Department Enquiry and to take Disciplinary Proceedings for the new Officers.     

    1) Immediately on the promotions of a Civil Judge Junior Division Judicial first class Magistrate,
    this sort of training programme may be arranged.

    2) A study on the assessment of disability with the help of  expert doctors can be arranged and also a Session on the study of injuries its long and short term implications on the human body also can be included.

Reflective Training Programme for the Newly Recruited Civil Judges (Junior Division)
6th & 7th March 2010

  • A Separate programme may be conducted pertaining to maintaining hormony between Bench and Bar and tackle the situation when any unwanted thing is going on in the Court.
  • To make this Reflective Training programme, more effective the number of days of training programme can be increased, since due to paucity of time, many topics could not be discussed by resource persons.
  • If my Judgment is valued I can concentrate on that area, where it needs betterment in future.
  • This programme made us to get our doubts be cleared through our colleagues and through the learned resource persons. Further the group discussion helped us to know about the practical difficulties faced by the Judicial officers in our day to day court proceedings and the ample methods to face and tackle them in a proper and lawful manner.
  • The first and foremost precedent judgments of Supreme Court regarding each important legal provisions in CPC, CRPC & Evidence Acts may kindly be provided with us in order to know about the change of positions in the present legal system so that we could be more aware of the procedural laws and legal principles to be applied in our judgments and orders.
  • It would be more useful to us if we can contact the Academy round the clock to avoid even small mistakes and our doubts be clarified through websites. Even by reporting landmark selected judgments through websites like other Journal websites.

  • Each participant shall be given an opportunity to present their views relating to the objects and subjects and the same shall be heard and deliberated, if time is not sufficient, one more day may be added in the programme.
  • The programme should be for minimum four days, after lunch session should be only for interaction, some games may be arranged after 4.30.pm.
  • Separate CD may be circulated for particular cases eg. 138 N.I. Act (which should give the entire important judgments)
  • There must be a separate website for  TNSJA in which all the Judicial Officers (past, present, future) will be members, in which interaction can be through the same.

  • TNSJA shall create a question bank with answers.

  • The Asst. Public Prosecutors to sent a copy of their leave letter to the J.M. Court also. In practice twice a week they inform by phone to the MC/Police, they called not attended to the Court on that day, due to personnel reasons, without applying leave, which affects examination of witness posted on that day.
  • Periodical refresher course to be given to us.  It is very useful to update our legal knowledge, amendments, new acts, citations.

  • We need periodical workshops because it cultivates our Judicial mind.  It gives strength and courage to perform the judicial work.
  • In Cheque cases the Court fees is very low comparing with money claim.  Hence the finance company use the Court and their business purpose, hence Court fee to be raised. 
  • Examination for staff, so that due to compulsion they have to learn something.
  • Direction to be given to Government to fix norms to the Police also to produce the witnesses
  • Workshop may be conducted in a periodically (once in three months or four months)
  • Workshop may be focused mainly upon the particular district i.e. what type of cases are largely pending in that District and solutions may be discussed and given to clear those cases for that District.
  • The system may be followed on Court wise, subject wise, provision wise, in solving those cases.
  • Workshop may be particularly on a particular subject conducted.
  • The Training programme is very much useful, such a training may be given in the filed of writing good and effective judgment.
  • The workshop may be conducted for once in three months for four days.
  • A Compulsory subject of Computer should be included in every workshop.

    10th to 12th July 2009

    • In fact group discussions make an impact of one’s opinion upon others instead of being useful.  Hence, they may be avoided and emphasis may be laid on each subject to make the Judicial Officers to be well versed in law.
    • If these programmes are conducted at Judicial Academy Chennai it will be more comfortable for us.  Once in a year a programme like this may be conducted to refresh and update our knowledge separately for Civil and Criminal Wing.
    • More than one half of the IPC Cases in Magistrates Court involves offence u/s 506(2) IPC.  Normally the other offence are individual in nature like 341, 294(b) IPC.  Only because of the charge u/s 506(2) IPC the accused are not pleading guilty.  It is learned that either the Policeman or the Lawyers are including the overt Act to attract the defence u/s 506 (2) IPC in the FIR.  It is only false allegations only to confine the accused in prison.  Whether this can be discussed with higher police officials? Thus considerable number of case will be reduced all over state.

    • Since most of the Judicial Officers are not fluent in communicative skills in English, even though they have so many good ideas, they are reluctant to disclose them for fear of committing errors, so the language of communication should both be in English and in Tamil.
    • All the Judicial Officers should be given an opportunity to see and witness the proceedings of the highest forum of this Country, i.e. The Supreme Court, at the cost of Judicial Academy.
    • To constitute the separate and special Judicial Police wing under the control of district Judiciary which enables the court for effective service of summons, execution of NBW etc. in criminal cases and to reduce the long duration in disposal of cases.
    • Special Workshops on analysis of scientific evidence with the participation of Professors of Forensic Science Department of Medical Colleges and T.N. Forensic Science Department Regional wings may be introduced.
    • May be provided with CD copy of all the speeches of the Hon’ble High Court Judges to all the participants so that the hard efforts of the Hon’ble High Court Judges would be helpful for the participants.
    • These type of Training Workshops is to given to the Advocates also.  So that it is easier for the Judges for speedy disposal of cases which paves way for timely Justice which is the objective of the programme.
